1. Promoter

Believe Direct Limited, registered under the number 06864987, with its registered office 2 and 2a Tileyard London, Tileyard Road, London, N7 9AH, England (the “Promoter”) organizes a free prize draw, with no necessary purchase, from {startDate} to {endDate} at midnight, accessible online only (the “Prize Draw”).

2. Eligibility

The Prize Draw is open to all residents from {territory} aged {minimumAge} years or over at the time of their participation (the “Participants”), except employees of the Promoter and its affiliated companies, or of its suppliers, service providers, agents or any third party directly associated with the administration of the Prize Draw.

Each Participant can only participate once (same name and/or address and/or phone number and/or email address).

3. How to Enter

To enter the Prize Draw, the Participant shall:

Save a piece of content from {artistName} in the music streaming service of his/her choice (Spotify, Apple Music, etc…),
Fill in and validate the online participation form.

The Participant is responsible for all service costs associated with entering the Prize Draw (if any), such as internet connection costs. The Participant will not be able to request reimbursement of such costs from the Promoter.

4. Selection of winner(s)

{winnersCount} winners will be chosen by a computer processed random draw within 15 days following the end of the Prize Draw (the “Winners”).

The Winner(s) will be informed by email or text message within 7 days following the draw (the “Notification”) and must provide in answer his/her name and a postal address where the prize will be sent, if this prize cannot be sent by email. Other Participants will not be contacted by the Promoter.

5. Prizes

The randomly selected Winners will win the following prizes:

These prizes cannot be substituted (including for cash) or exchanged.

The prizes delivery will be undertaken by the Promoter, at their cost, by post or email within 30 days of the Notification.

Any prize which cannot be delivered, or is sent back to the Promoter for reasons not attributable to the Promoter (wrong address provided, no answer from the Participant, etc.) can be claimed by the Winner for up to 1 month following the Notification. After this time, the prize can no longer be claimed and there will be a redraw conducted in the same way as the original draw.

6. Liability

The Promoter shall not be held responsible for Force Majeure events, or any event beyond the Promoter’s reasonable control, affecting the Prize Draw. In such a case, the Promoter can, at its sole discretion, cancel, modify, shorten or prolongate the Prize Draw, or replace the advertised prize with another prize of similar value.

7. Personal Information

Personal Information (identity and contact details) provided by the Participant upon his/her entering the Prize Draw or by the Winner following the Notification, will be processed by the Promoter, as the data controller, based on the consent of the Participants.

Personal Information will be stored in an electronic file and are necessary for the processing of the Prize Draw’ participation, determination of the Winners, and delivery of the prizes.

The Promoter will also make available information that indicates that a valid draw took place. To comply with this obligation the Promoter will send the surname, county and winning entry of Winners, to anyone who emails or writes to them (enclosing a self-addressed envelope) within 1 month after the closing date stated in section 1.

If a Participant objects to any or all of his/her surname, county and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

Personal Information will be accessible only to the Promoter’s marketing teams and to the Promoter’s service providers involved with the Prize Draw operation (if any).

In addition to its participation in the Prize Draw, the Participant can also choose to receive, from time to time, information about the artist through emails from the Promoter. This subscription is optional, and the Participant can unsubscribe at any time by clicking on “unsubscribe” in the email received.

The Participant can access his/her Personal Information stored by the Promoter, correct it or request it to be erased, or ask for the Promoter to send him/her a copy of said information. To exercise these rights or for any questions regarding the processing of his/her Personal Information, the Participant can contact the Promoter by filling the following form.

If the Participant considers, after contacting the Promoter, that his/her privacy rights are not respected, he/she can file a claim with the Information Commissioner’s Office at https://ico.org.uk/make-a-complaint/.

8. Miscellaneous

Participation to the Prize Draw implies unconditional acceptance of these Prize Draw rules. Any Participant in breach of these rules or trying to increase his/her chances to win by fraud, in any way whatsoever, can be excluded from the Prize Draw.

The Prize Draw will be governed by English law and Participants to the Prize Draw submit to the jurisdiction of the English courts.
